Terms and Conditions are effective as of October 15, 2024 for the Instant Rebate Smart Thermostats program offered by Enbridge Gas Inc.

This Rebate-as-a-Service platform (the “Platform”), which is provided by Enbridge Gas Inc. (“Enbridge Gas”) and hosted / delivered by Summerhill Group Inc. (“Summerhill”), allows eligible residential customers to participate in the Post-Purchase Rebate Smart Thermostat Program (the “Program”). The Program is offered by Enbridge Gas and delivered by Summerhill.

Under the Program, subject satisfying the Enbridge Gas Eligibility Requirements (as defined below), Enbridge Gas residential customers may be eligible to receive an incentive in the form of an instant rebate (the “Instant Rebate”) of $75 on the purchase of a qualified Smart Thermostat (as defined below).1

The terms and conditions ("Terms and Conditions") set out herein are effective as of October 15, 2024 and apply to the Program.

"Smart Thermostat" means any of the products listed in the Platform at enbridgegas.com/smartthermostat (as may be amended by Enbridge Gas from time to time).

By participating in the Program, you acknowledge and agree to these Terms and Conditions. Further, your participation in the Program gives Enbridge Gas, Summerhill and the Smart Thermostat manufacturer permission to access, use and share your information (including your Personal Information) for the purposes identified in these Terms and Conditions. "Personal Information" means your name, address, telephone number, email address, and Enbridge Gas account number. See Personal Information section below.

Enbridge Gas may share certain information including, but not limited to, your name, email address, service address, phone number, Enbridge Gas account number (if applicable), primary home heating fuel type, retailer where you purchased your Smart Thermostat, Smart Thermostat brand and model number, Smart Thermostat serial number, Smart Thermostat activation date, account status with the Smart Thermostat provider, whether or not you have central air conditioning with a standard thermostat (as identified by the manufacturer), the installation date of your central air conditioning, other information submitted by you in the Platform or communicated to Enbridge Gas by any other medium, and related details.

Such information may be shared for purposes which include: to evaluate the comprehensive energy impact of the Smart Thermostat; to develop new programs and services; and to evaluate the Program.

Eligibility Requirements – Enbridge Gas

The Instant Rebate is available to participants who meet the following eligibility requirements (the “Enbridge Gas Eligibility Requirements”): (1) you must have an active Enbridge Gas account as validated via the Platform; (2) you must purchase, install and activate a qualified Smart Thermostat between October 15, 2024 and December 31, 2025 (3) your Smart Thermostat must control your primary heating source, which must be fuelled entirely by natural gas (hybrid heating is not eligible); (4) the residence that is linked to your Smart Thermostat must be located within the Enbridge Gas Franchise Service Area; (5) your residence must be a single family home (detached, semi-detached, and townhouse homes only); and (6) you must have a Wi-Fi connection at your residence sufficient to communicate to the manufacturer that your Smart Thermostat has been successfully installed. Only one device per residence permitted. Participants who reside in multi-unit residential buildings, condominiums are not eligible for the Instant Rebate. Enbridge Gas customers residing in the former Union Gas Limited service area are eligible to apply for the Instant Rebate.

Participation in the Program is limited to one Instant Rebate per household. Instant Rebate cannot be combined with any rebate offered by Enbridge Gas in connection with Enbridge Gas’s Post-Purchase Smart Thermostats program. The offer ends on December 31, 2025. Program is subject to change at any time.

Email Consent - CASL

Pursuant to Canada’s anti-spam legislation (“CASL”), Enbridge Gas, on its own behalf and on behalf of Summerhill, is hereby requesting your consent for Enbridge Gas and Summerhill to contact you at the electronic address provided by you as part of the information collected on the Platform. By participating in the Program, you consent to Enbridge Gas and Summerhill communicating with you by email in connection with future conservation programs, customer satisfaction surveys and other related purposes.

General

Terms and Conditions take effect as of October 15, 2024. The Instant Rebate has no cash value. Offer available to residential Enbridge Gas customers who reside within the Enbridge Gas Franchise Service Area.

The Instant Rebate will be paid at the Point of Sale either on-line via store.google.com, ecobee.com, bestbuy.ca and emersoncanada.ca/store or in-store at participating retailers.
By completing this transaction to receive your Instant Rebate, you confirm that you have read, understood and agree to these Terms and Conditions, and that you meet all Enbridge Gas Eligibility Requirements.

Enbridge Gas and Summerhill reserve the right to contact you and seek further information to verify your eligibility for the Instant Rebate. You agree to participate in any follow-up surveys, studies, audits, evaluations or verifications conducted by Enbridge Gas or Summerhill and each of their respective service providers and agents in connection with the Program, including for the purposes of the proper administration, monitoring and verification or evaluation of the Program and will provide to them reasonable access to your records and facilities for such purpose. You agree that Enbridge Gas and Summerhill may contact you for marketing purposes in connection with energy efficiency programs.

You acknowledge and agree that any environmental attributes that may arise as a result of or in connection with your receipt of a Post-Purchase Rebate or your participation in the Program shall vest with Enbridge Gas. Upon direction from Enbridge Gas, you agree to take all actions necessary to effect the transfer and assignment to, or holding in trust for, Enbridge Gas of rights, title, and interest in environmental attributes and certify, obtain, qualify and register with relevant authorities the environment attributes that Enbridge Gas is entitled to own and that you will be entitled to reimbursement of the cost of complying with such a direction subject to Enbridge Gas’s prior reasonable approval of such cost. Amendment

Enbridge Gas may change, modify, add or remove portions of these Terms and Conditions and change, modify, suspend or terminate the Program at any time. Enbridge Gas will notify you of any changes to these Terms and Conditions by posting notice of such changes at enbridgegas.com/smartthermostat (as may be amended by Enbridge Gas from time to time). Please periodically review these Terms and Conditions. Your continued usage of the Program will mean acceptance of any changes to the Program or the Terms and Conditions.

Limitation of Liability and Indemnity

You are solely responsible for determining and ensuring that the Smart Thermostat is suitable for your residence before installation.

You represent and warrant that you have the full, unfettered authority to participate in the Program and will successfully install and activate the Smart Thermostat at your residence.

You acknowledge and agree that none of Enbridge Gas or Summerhill make any representation or warranty whatsoever, whether express or implied, as to any part of the Smart Thermostat, its design, quality, capability, reliability, operation, performance, safety, fitness for your purposes, or as to any material, equipment or workmanship relating to part of the Smart Thermostat, its installation, operation or warranties.

You assume all risk, responsibility and liability for any damages, injury and/or costs that may result from the installation, operation, use and/or removal of any part of the Smart Thermostat.

You hereby release, indemnify and save harmless Enbridge Gas, Summerhill, and their respective agents and employees from any liability, claim, demand, cause of action, damage or expense arising from or relating to your participation in the Program and from your installation, operation, use and/or removal of the Smart Thermostat, whether or not in accordance with the manufacturer’s instructions or otherwise.

Eligibility Requirements – Enbridge Gas

The Post-Purchase Rebate is available to participants who meet the following eligibility requirements (the “Enbridge Gas Eligibility Requirements”): (1) you must have an active Enbridge Gas account as validated via the Platform; (2) you must purchase, install and activate a qualified Smart Thermostat between October 15, 2024 and December 31, 2025; (3) your Smart Thermostat must control your primary heating source, which must be fuelled entirely by natural gas (hybrid heating is not eligible); (4) the residence that is linked to your Smart Thermostat must be located within the Enbridge Gas Franchise Service Area; (5) your residence must be a single family home (detached, semi-detached, and townhouse homes only); (6) you must apply for the Post-Purchase Rebate within 60 days of purchasing a qualifying Smart Thermostat; (7) in respect of the qualifying Smart Thermostat, you must upload a clear image of the invoice showing as a separate line item with the purchase date, device model, pre-tax cost, and retailer; (8) the Smart Thermostat purchased must not be a used or refurbished model; (9) the pre-tax cost of the Smart Thermostat must not be less than the Post-Purchase Rebate amount; and (10) you must have a Wi-Fi connection at your residence sufficient to communicate to the manufacturer that your Smart Thermostat has been successfully installed. Only one device per residence permitted. Participants who reside in multi-unit residential buildings, condominiums are not eligible for the Post-Purchase Rebate. Enbridge Gas customers residing in the former Union Gas Limited service area are eligible to apply for the Post-Purchase Rebate. All applications for a Post-Purchase Rebate will be subject to review by Enbridge Gas or Summerhill to determine whether the participant has satisfied all Enbridge Gas Eligibility Requirements. For further clarity, submission of an application for a Post-Purchase Rebate by any participant does not guarantee the receipt by such participant of any Post-Purchase Rebate or any other incentive from Enbridge Gas.

Participation in the Program is limited to one Post-Purchase Rebate per household. Post-Purchase Rebate cannot be combined with any rebate offered by Enbridge Gas in connection with Enbridge Gas’s Instant Rebate Smart Thermostats program. The offer ends on December 31, 2025.
